Con il tempo per\u00f2 le situazioni possono cambiare e pu\u00f2 nascere il bisogno di sciogliere questo vincolo. Le principali soluzioni sono: accollo del mutuo, sostituzione o surroga, vendita dell\u2019immobile o cessione delle proprie quote. \u00c8 importante verificare le condizioni previste dalla banca.<\/p>\n<hr data-start=\"529\" data-end=\"532\" \/>\n<h2 data-start=\"534\" data-end=\"570\"><strong data-start=\"537\" data-end=\"570\">1. Cos\u2019\u00e8 un mutuo cointestato<\/strong><\/h2>\n<p data-start=\"571\" data-end=\"971\">Il mutuo cointestato \u00e8 un finanziamento firmato da due o pi\u00f9 persone. Vale il principio di <strong data-start=\"662\" data-end=\"685\">solidariet\u00e0 passiva<\/strong>: tutti i firmatari sono responsabili del pagamento dell\u2019intero debito.<br data-start=\"756\" data-end=\"759\" \/>La banca pu\u00f2 quindi richiedere le rate a qualunque cointestatario, anche se internamente le spese sono divise diversamente.<br data-start=\"882\" data-end=\"885\" \/>Il vincolo resta anche dopo una separazione, finch\u00e9 il contratto non viene modificato.<\/p>\n<hr data-start=\"973\" data-end=\"976\" \/>\n<h2 data-start=\"978\" data-end=\"1023\"><strong data-start=\"981\" data-end=\"1023\">2. Come uscire da un mutuo cointestato<\/strong><\/h2>\n<p data-start=\"1024\" data-end=\"1167\">Non si pu\u00f2 lasciare un mutuo da soli: serve l\u2019accordo degli altri cointestatari e <strong data-start=\"1106\" data-end=\"1136\">l\u2019approvazione della banca<\/strong>. Le soluzioni principali sono:<\/p>\n<ul data-start=\"1169\" data-end=\"1613\">\n<li data-start=\"1169\" data-end=\"1257\">\n<p data-start=\"1171\" data-end=\"1257\"><strong data-start=\"1171\" data-end=\"1196\">Vendita dell\u2019immobile<\/strong>: il ricavato estingue il mutuo e libera tutti i firmatari.<\/p>\n<\/li>\n<li data-start=\"1258\" data-end=\"1337\">\n<p data-start=\"1260\" data-end=\"1337\"><strong data-start=\"1260\" data-end=\"1285\">Estinzione anticipata<\/strong>: si paga il debito residuo in un\u2019unica soluzione.<\/p>\n<\/li>\n<li data-start=\"1338\" data-end=\"1453\">\n<p data-start=\"1340\" data-end=\"1453\"><strong data-start=\"1340\" data-end=\"1361\">Accollo del mutuo<\/strong>: un cointestatario rileva la quota dell\u2019altro, ma la banca deve valutarne la solvibilit\u00e0.<\/p>\n<\/li>\n<li data-start=\"1454\" data-end=\"1613\">\n<p data-start=\"1456\" data-end=\"1613\"><strong data-start=\"1456\" data-end=\"1475\">Accollo interno<\/strong>: uno paga al posto dell\u2019altro, ma verso la banca restano entrambi responsabili.<br data-start=\"1555\" data-end=\"1558\" \/>Se non si trova un accordo, pu\u00f2 intervenire il giudice.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1615\" data-end=\"1618\" \/>\n<h2 data-start=\"1620\" data-end=\"1661\"><strong data-start=\"1623\" data-end=\"1661\">3. Come togliere un cointestatario<\/strong><\/h2>\n<p data-start=\"1662\" data-end=\"1779\">Se uno vuole restare unico titolare del mutuo, deve dimostrare di poter sostenere da solo il debito. Le opzioni sono:<\/p>\n<ul data-start=\"1781\" data-end=\"2115\">\n<li data-start=\"1781\" data-end=\"1810\">\n<p data-start=\"1783\" data-end=\"1810\"><strong data-start=\"1783\" data-end=\"1808\">Estinzione anticipata<\/strong><\/p>\n<\/li>\n<li data-start=\"1811\" data-end=\"1849\">\n<p data-start=\"1813\" data-end=\"1849\"><strong data-start=\"1813\" data-end=\"1847\">Accollo delle quote dell\u2019altro<\/strong><\/p>\n<\/li>\n<li data-start=\"1850\" data-end=\"1971\">\n<p data-start=\"1852\" data-end=\"1971\"><strong data-start=\"1852\" data-end=\"1863\">Surroga<\/strong>: si sposta il mutuo in un\u2019altra banca e si chiede l\u2019intestazione a una sola persona (gratuita per legge).<\/p>\n<\/li>\n<li data-start=\"1972\" data-end=\"2115\">\n<p data-start=\"1974\" data-end=\"2115\"><strong data-start=\"1974\" data-end=\"2000\">Sostituzione del mutuo<\/strong>: si chiude quello vecchio e se ne apre uno nuovo a nome di un solo intestatario (con costi notarili e istruttori).<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2117\" data-end=\"2120\" \/>\n<h2 data-start=\"2122\" data-end=\"2163\"><strong data-start=\"2125\" data-end=\"2163\">4. Mutuo cointestato e separazione<\/strong><\/h2>\n<p data-start=\"2164\" data-end=\"2304\">La separazione, di coniugi o conviventi, <strong data-start=\"2205\" data-end=\"2249\">non modifica gli obblighi verso la banca<\/strong>. Se uno non paga, l\u2019altro pu\u00f2 essere chiamato a farlo.<\/p>\n<p data-start=\"2306\" data-end=\"2334\">Le soluzioni possibili sono:<\/p>\n<ul data-start=\"2336\" data-end=\"2579\">\n<li data-start=\"2336\" data-end=\"2389\">\n<p data-start=\"2338\" data-end=\"2389\"><strong data-start=\"2338\" data-end=\"2363\">Vendita dell\u2019immobile<\/strong> ed estinzione del mutuo<\/p>\n<\/li>\n<li data-start=\"2390\" data-end=\"2436\">\n<p data-start=\"2392\" data-end=\"2436\"><strong data-start=\"2392\" data-end=\"2403\">Accollo<\/strong> da parte di un solo ex partner<\/p>\n<\/li>\n<li data-start=\"2437\" data-end=\"2496\">\n<p data-start=\"2439\" data-end=\"2496\"><strong data-start=\"2439\" data-end=\"2465\">Surroga o sostituzione<\/strong> del mutuo a nome di uno solo<\/p>\n<\/li>\n<li data-start=\"2497\" data-end=\"2579\">\n<p data-start=\"2499\" data-end=\"2579\"><strong data-start=\"2499\" data-end=\"2524\">Decisione del giudice<\/strong> in caso di mancato accordo (anche con vendita forzata)<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2581\" data-end=\"2696\">\u00c8 consigliabile documentare tutti i pagamenti e rivolgersi a un avvocato o a un notaio per accordi chiari e validi.<\/p>\n<hr data-start=\"2698\" data-end=\"2701\" \/>\n<p data-start=\"2703\" data-end=\"2868\" data-is-last-node=\"\" data-is-only-node=\"\">\n","protected":false},"excerpt":{"rendered":"<p>Quando si compra casa insieme a un partner o un familiare, \u00e8 comune sottoscrivere un mutuo cointestato.
